It’s time to rally the majority against the Supreme Court

The conservatives justices have corrupted the highest judiciary in the land and made it an instrument of anti-majoritarian rule. It's time to sound the alarm and mobilize the majority.

If Democrats had spine and smarts, they’d make the Supreme Court the top priority for undecided and disaffected voters ahead of the 2024 election. For decades, right-wing media has rallied Republican voters with fear-mongering allegations of activist judges. Well, this Supreme Court’s conservative majority has confirmed they exist simply to serve the extremist ideological agenda of Christian nationalists, MAGA, and billionaire sugar daddies. If the central story of the Biden campaign is that Democrats will fight to protect our freedoms and democracy, then this rogue Supreme Court has emerged as the perfect diabolical supervillain who will stand in the way.

I’m not using hyperbolic language for dramatic effect. I’m simply analyzing this corrupt Supreme Court’s behavior, both literally and seriously. In the same week Americans celebrate Independence Day, these “originalist” conservative judges ruled that the President has “absolute immunity” for any criminal acts provided it was done as an official act.

Ah, yes, I recall being taught in elementary school how the Founding Fathers rebelled against the British Empire and successfully fought the American Revolution so they could have a dictator with near unlimited power - but without a British accent. According to this ruling, a President can now order the assassination of his political rivals, perhaps even Supreme Court justices he doesn’t like, and weaponize the Justice Department to attack and silence all critics. 

“It’s good to be the king,” to quote Mel Brooks from History of the World: Part 1. He was parodying King Louis XVI, the last king of France. Donald Trump can now repeat the line if he wins another election and begins his reign as the first king of white Christian nationalist America. We should all heed the words of Justice Sotomayor, who wrote a powerful and chilling dissent warning the nation that the conservative majority’s ruling has now made the President “a king above the law.” Make no mistake, the Supreme Court’s ahistoric and dangerous ruling was done purely to help Donald Trump escape any and all accountability for his numerous alleged criminal acts, which include inciting a violent insurrection and deliberately stealing and storing classified documents that potentially compromised our nation’s security. This ruling punts the case down to lower counts to decide if Trump’s crimes were done as “unofficial acts'' and are thus subject to prosecution. Realistically, Trump will never see the inside of a jail cell, and if he wins he will be rewarded for trying to steal a free and fair election. 

Also, it always bears reminding Americans that Ginni Thomas, the batshit activist spouse of Justice Clarence Thomas, initially supported the Jan 6th insurrection. Marth-Ann Alito, the batshit activist spouse of Justice Samuel Alito, flew traitorous flags at two separate properties. Neither justice recused themselves from this case, or the other Jan 6th case in which the conservative majority greatly limited the government’s ability to prosecute Trump and his violent insurrectionists thanks to their narrow interpretation of an obstruction statute. President Trump installed three of these extremist judges, while Republicans denied President Obama an opportunity to even have vote for Merrick Garland. 

Not content with simply destroying separation of powers, the conservative majority also overturned the Chevron doctrine, which allows the courts to defer to government regulatory agencies, filled with subject matter experts, to interpret unclear laws. The grooming of Supreme Court justices resulted in massive long term rewards for right-wing billionaires and corporations, who have spent decades having wet dreams of de-regulation and gutting federal oversight. They no longer need to dream. Who needs the expertise of medical experts, scientists, and meteorologists when you have the free market and thoroughly corrupt judges who serve the interest of their corporate sugar daddies? We obviously don’t need to defer to their expertise for clean air, clean water, climate change, and food and drug safety. You know, the trivial stuff. This Supreme Court also criminalized homeless people while allowing the bribery of public officials. And we haven’t talked about them overturning Roe v Wade and sabotaging abortion rights. Apparently, this Supreme Court wants to regulate nothing except women’s bodies. Oh, and they’re most likely going to go after marriage equality and birth control next. 

An extremist, unelected court that serves a lifetime appointment must be reined in or else we will all be living in their Handmaid’s Tale dystopia. They have shown they have no problem subverting our Constitution, weakening our democracy, and thumbing their nose at the majority as a means of achieving their Christian Valhalla. They are doing their part as dutiful, faithful soldiers of Christ and implementing the long-term conservative plan clearly outlined in Project 2025, which would create a right-wing, counter-majoritarian rule in America in which the rest of us must yield to MAGA or be punished. 

The stakes are clear. It’s time for all of our institutions, and anybody who cares about our democracy, to sound the alarm. If you’re disaffected and unexcited about President Biden and Democrats, well, you better wake up and get excited. The next President of this country will have the chance to possibly appoint up to three Supreme Court justices. Elections matter. This isn’t about “Biden v. Trump.” It’s about a protecting and reforming a flawed democracy vs. living in an authoritarian, right-wing dictatorship. The Supreme Court, an unelected body with a lifetime appointment, is MAGA’s most powerful weapon and as such it remains the singular threat to undoing all the hard-fought progress and freedoms that were gained in the past century.
